The Ministry of Land, Infrastructure and Transport announced on the 23rd that it recently referred to the National Police Agency for investigation cases of violating regulations by arbitrarily modifying software, such as unauthorized activation of the supervised Full Self-Driving (FSD) function in some Tesla models in Korea.
The Ministry of Land, Infrastructure and Transport stated that it has been monitoring the occurrence of illegal activities since Tesla Korea recognized vulnerabilities in vehicle software related to unauthorized FSD activation attempts and reported a cyber security threat situation for automobiles late last month.
Following the report, Tesla remotely deactivated vehicles where users had arbitrarily activated FSD, in accordance with the Automotive Cyber Security Management System (CSMS).
As a result, attempts at arbitrary activation decreased sharply this month, but as attempts continued in some vehicles, it led to the Ministry of Land, Infrastructure and Transport's request for investigation. The National Police Agency plans to initiate an investigation after receiving relevant data from Tesla Korea.
In Korea, Tesla's FSD function can only be used by US-produced Model S and X, and Cybertruck, which are exempt from automobile safety standard certification under the Free Trade Agreement (FTA). However, attempts to activate FSD using unofficial external equipment or open source code have recently continued in models such as the China-produced Model Y.
The Ministry of Land, Infrastructure and Transport considers unauthorized activation of Tesla's FSD function to be an act of 'arbitrarily changing, installing, adding, or deleting software that can affect the safe operation of an automobile,' which is prohibited under the Automobile Management Act. Violators can be sentenced to imprisonment for up to 2 years or a fine of up to 20 million won.
The Ministry of Land, Infrastructure and Transport stated, "As automobiles transition to connected cars and software-defined vehicles (SDVs), safety management for automobile software is being strengthened internationally," and "arbitrary modification of software that affects the safe operation of an automobile is strictly restricted."
