U.S. Senator Ron Wyden, a Democrat, urged Senate leadership to retain the blockchain developer protection clause, one of the key issues of the CLARITY Act, in the final bill. In a letter sent to Senate Minority Leader John Thune and Senate Majority Leader Chuck Schumer, Senator Wyden requested that Section 604, the Blockchain Regulatory Certainty Act (BRCA), be included in future amendments to the CLARITY bill. BRCA was originally introduced as a separate bill but has since been integrated into the CLARITY bill. This provision aims to establish legal safeguards to prevent non-custodial blockchain software developers from being classified as money transmitters. The bill was initially introduced earlier this year by Republican Senator Cynthia Lummis, with Senator Wyden being the sole Democratic co-sponsor. Senator Wyden emphasized, "Wise policy enables both law enforcement and innovation. BRCA must be included in the process of discussing the bill." The cryptocurrency industry supports this provision, stating that it provides legal clarity for developers and helps prevent blockchain development activities from moving overseas. However, some law enforcement agencies oppose it, arguing that it could weaken necessary protections for combating human trafficking and investigating crimes.
