"Will become the most hated person in America"... OpenAI: "Shows the purpose of the lawsuit is to attack a competitor."
It has emerged that Elon Musk, Tesla CEO, who filed a lawsuit alleging that OpenAI unfairly became a for-profit company after abandoning its non-profit promise, attempted to reach a settlement with OpenAI just before the trial began.
According to documents submitted to the court by OpenAI on the 4th (local time), CEO Musk sent a text message to Greg Brockman, president of OpenAI, asking about his willingness to settle.
When President Brockman replied that both sides should withdraw the lawsuit, CEO Musk retorted, "Within this week, you and Sam (Altman, OpenAI CEO) will become the most hated people in America," adding, "If you insist, that's what will happen."
OpenAI's legal team requested the court to allow President Brockman to testify regarding this text message, stating that it could be admitted as evidence in the trial under federal rules of evidence.
OpenAI pointed out that the message "shows that Musk's motive for filing this lawsuit was to attack a competitor and its executives (rather than seeking legal redress)."
CEO Musk filed the lawsuit, alleging that OpenAI abandoned its mission to develop AI for the public good and transitioned into a Public Benefit Corporation (PBC) that can pursue profit, thereby allowing CEO Altman and President Brockman to obtain unjust enrichment.
Through this lawsuit, he is demanding the dismissal of OpenAI's two executives, Altman and Brockman, and the return of the unjust enrichment they obtained, totaling 134 billion dollars (approximately 19.8 billion KRW), to the OpenAI Foundation, a non-profit parent organization.
He also appeared as a witness in court from the 28th to the 30th of last month, lamenting, "I was a fool," stating that the initial funding of 38 million dollars he provided was used to create a for-profit company and enrich its executives.
President Brockman is expected to testify in court today, and subsequently, CEO Altman and Satya Nadella, Microsoft (MS) CEO, are also expected to take the stand.
